Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and NCLEX Kingdom ("we," "us," "our"). By creating an account, downloading the app, or using NCLEX Kingdom in any way, you agree to be bound by these Terms. If you do not agree, do not use the service.

Eligibility

NCLEX Kingdom is designed for nursing students preparing for the NCLEX-RN examination, who are typically 18 years of age or older. You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the service.

Account Responsibilities

  • You are responsible for keeping your login credentials secure.
  • You may only create and maintain one account per person.
  • You are responsible for all activity that occurs under your account.
  • If you believe your account has been compromised, contact us immediately at support@nclexkingdom.com.

Acceptable Use

When using NCLEX Kingdom, you agree not to:

  • Cheat, exploit bugs, or use unauthorized tools to gain an unfair advantage
  • Reverse-engineer, decompile, or disassemble any part of the app
  • Engage in abusive, harassing, or unsportsmanlike behavior in PvP battles or the Arena of Clinical Mastery
  • Share, redistribute, or sell NCLEX Kingdom question content, quest narratives, or other proprietary materials
  • Use the service to violate any applicable law or regulation
  • Attempt to access other users' accounts or private data

Content Ownership

Our content: NCLEX Kingdom, including all app code, realm designs, quest narratives, question content, artwork, characters, and game mechanics, is owned by us and protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Your content: You own the content you create within the app (such as your username and display name). By using the service, you grant us a limited, non-exclusive license to use your user-generated content solely to operate and improve NCLEX Kingdom.

Paid Features and Subscriptions

NCLEX Kingdom offers a premium subscription that unlocks additional content and features. By subscribing:

  • Your subscription auto-renews at the end of each billing period unless you cancel before the renewal date.
  • You can cancel your subscription at any time through the Apple App Store, Google Play Store, or RevenueCat customer portal. Cancellation takes effect at the end of the current billing period.
  • We do not issue refunds directly. Refunds are handled by Apple and Google according to their respective refund policies. If you believe you are entitled to a refund, contact Apple or Google through their standard refund process.

Not Medical Advice

NCLEX Kingdom is an educational product, not a clinical reference. The content in this app is designed to help you study for the NCLEX-RN examination. It is not medical advice, clinical guidance, or a substitute for professional judgment. You must not rely on NCLEX Kingdom content for patient care decisions. Always follow your nursing program's instruction, evidence-based clinical guidelines, and the direction of licensed healthcare professionals.

No Exam Guarantee

We do not guarantee that using NCLEX Kingdom will result in passing the NCLEX-RN or any other examination. NCLEX Kingdom is a study tool designed to supplement your exam preparation. Success on the NCLEX-RN depends on many factors including your nursing education, clinical experience, and individual study habits. We are not a substitute for nursing school or clinical judgment.

Termination

By us: We may suspend or terminate your account if you violate these Terms, engage in behavior that harms other users or the service, or for any other reason at our discretion. We will make reasonable efforts to notify you before termination, except in cases of severe or repeated violations.

By you: You may delete your account at any time by contacting us at support@nclexkingdom.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, NCLEX Kingdom's total liability to you for any claims arising from or related to these Terms or your use of the service is limited to the greater of (a) the total fees you have paid to us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from your reliance on content within the app.

Indemnification

You agree to indemnify, defend, and hold harmless NCLEX Kingdom, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of NCLEX Kingdom will be resolved exclusively in the state or federal courts located in Florida.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will notify you through the app or by email. Your continued use of NCLEX Kingdom after changes are posted constitutes acceptance of the updated Terms.
